Roam Golf – Terms & Conditions

Welcome to Roam Golf ("Roam Golf," "we," "our," or "us"). These Terms and Conditions ("Terms") govern your access to and use of the Roam Golf website, mobile applications, and related services (collectively, the "Platform").
By creating an account, browsing listings, renting, listing, or purchasing golf equipment through Roam Golf, you agree to be bound by these Terms. If you do not agree, you may not use the Platform.
1. Eligibility & Account Creation
- You must be at least 18 years old to create an account.
- You agree to provide accurate, current, and complete information when creating and maintaining your account.
- You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
- You may not create more than one account without our prior written permission.
Roam Golf reserves the right to suspend or terminate accounts that violate these Terms or that we reasonably believe may cause harm to the Platform or other users.
2. Marketplace Role & Platform Disclaimer
Roam Golf is a marketplace platform that facilitates connections between individual golfers, golf shops, and other approved equipment providers (each, a "Lister") and individuals seeking to rent or purchase golf equipment ("Renters").
Unless explicitly stated, Roam Golf does not own, store, inspect, or control the golf equipment listed on the Platform. All information about condition, specifications, availability, pricing, and suitability is provided by the Lister.
Listings are not reviewed or guaranteed by Roam Golf, and we do not warrant that any equipment will meet your expectations or be fit for a particular purpose.
3. Listings & Equipment Condition
For Listers (Individuals & Shops):
- You are responsible for accurately describing equipment condition, specifications, and availability, including any known defects or limitations.
- You may only list equipment you legally own or are authorized to rent or sell.
- Your listings must comply with all applicable laws, rules, and regulations.
- You agree to upload a minimum of three (3) clear photographs of the equipment at the time of listing and at the time of each pickup handover. These photos serve as the official record of equipment condition and may be used in the event of a damage dispute.
Roam Golf may edit, pause, or remove listings that are misleading, unsafe, illegal, or otherwise violate these Terms, but we are not obligated to monitor all listings.
4. Pickup Process & Handover Verification
Roam Golf uses a code-based verification system to confirm equipment handover between Listers and Renters.
- Prior to pickup, Listers must complete all required setup steps, including uploading a minimum of three (3) pre-handover photographs and generating a unique pickup code through the Platform.
- Pickup is confirmed when the Renter enters the correct pickup code into the Platform. Entry of the correct code constitutes the Renter's acknowledgment that they have received the equipment and accept its condition as documented by the Lister's photos.
- If a Lister fails to complete the required pickup steps before or on the booking start date, the Renter may cancel the booking and receive a full refund regardless of the standard cancellation policy or proximity to the start date.
- Listers who fail to complete the pickup process on or before the booking start date may be subject to a cancellation fee and account review.
5. Rentals
- Rental terms, including price, duration, and pickup and return details, are set by the Lister and shown prior to booking confirmation.
- Renters are responsible for returning equipment on time, in the condition received (normal wear and tear excepted), and to the agreed location or person.
- At the time of return, Renters must upload a minimum of three (3) clear photographs documenting the condition of the equipment through the Platform. These photos form the official return record and are used to verify condition.
- The return must be confirmed by the Lister through the Platform. Until a return is confirmed, the Renter remains responsible for the equipment.
6. Late Returns & Late Fees
Equipment is due back by 11:59 PM on the final day of the booking period.
- Late fees begin at 12:00 AM on the day following the booking end date, equal to one additional day's rental rate per day late.
- Late fees are capped at a maximum of two (2) additional days' rental rate.
- Late fees are charged automatically off-session to the payment method on file and are non-negotiable unless an error can be demonstrated.
- Late fees apply only when the booking is in an active rental status. If the Lister did not complete the pickup process and the Renter never received the equipment, late fees will not be assessed.
7. Damage, Loss & Stolen Equipment
Damage Fees:
If a Lister reports damage after return, a damage fee may be assessed based on the severity of the damage relative to the equipment's listed purchase price:
- Minor damage: up to 25% of the listed purchase price.
- Moderate damage: up to 50% of the listed purchase price.
- Major damage: up to 75% of the listed purchase price.
- Total loss or destruction: up to 100% of the listed purchase price.
Damage fees are assessed by Roam Golf based on documentation provided by both parties. Damage fees are charged off-session to the Renter's payment method on file.
Damage Dispute Window:
Renters have 48 hours from the time a damage fee is assessed to file a dispute through the Platform. After the 48-hour window, the damage fee is considered final and non-refundable. Disputed fees are reviewed by Roam Golf support, whose decision is final.
Lost or Stolen Equipment:
- If equipment is reported lost or stolen, the Lister may initiate a lost/stolen claim through the Platform no earlier than 48 hours after the booking end date.
- If a lost/stolen claim is approved, the Renter will be charged the full listed purchase price of the equipment, less any rental amounts already collected.
- This charge is processed off-session to the Renter's payment method on file and is treated as a forced purchase of the equipment.
8. Cancellations & Refunds
Renter-Initiated Cancellations:
- Cancellations made more than 48 hours before the booking start date will receive a full refund.
- Cancellations made within 48 hours of the booking start date are non-refundable, except as noted below.
- If the Lister has not completed the required pickup setup steps and the booking start date has passed, the Renter may cancel and receive a full refund regardless of the 48-hour policy.
Lister-Initiated Cancellations:
- If a Lister cancels a confirmed booking, the Renter will receive a full refund.
- Listers who cancel confirmed bookings may be subject to a cancellation fee of $5.00, deducted from a future payout, to cover processing costs.
- Repeated cancellations by a Lister may result in account suspension or removal from the Platform.
Refunds are issued to the original payment method and may take 5–10 business days to appear depending on your financial institution. Roam Golf is not responsible for delays caused by payment processors or banks.
9. Optional Purchase ("Rent-to-Own")
Some listings include an option for the Renter to purchase the equipment after or during a completed rental.
- The purchase price is set by the Lister and displayed on the listing before booking.
- If a Renter elects to purchase, the total rental fees paid are credited toward the purchase price. The Renter is charged the remaining balance (the "purchase remainder") off-session through the Platform.
- A Roam Golf platform fee of 10% applies to the purchase remainder amount and is deducted from the Lister's payout.
- Once a purchase is confirmed, no return is required. The booking is marked as purchased and the Renter takes full ownership of the equipment.
- Unless otherwise required by law, purchases are final and non-refundable.
Roam Golf does not guarantee ongoing availability of any equipment for purchase or its condition beyond what is disclosed by the Lister.
10. Platform Fees
Renter Service Fee:
A service fee of 10% of the rental subtotal is charged to Renters at checkout. This fee is displayed before payment is confirmed and is non-refundable except in cases where a full refund is issued under these Terms.
Lister Listing Fee:
A platform fee of 10% is deducted from the Lister's payout for each completed rental and each rent-to-own purchase transaction. Roam Golf does not charge a fee on lost/stolen purchase charges unless otherwise stated.
Roam Golf reserves the right to adjust its fee structure with reasonable advance notice to users. Continued use of the Platform after a fee change constitutes acceptance of the new fee structure.
11. Payments, Payouts & Stripe Connect
- All payments on the Platform are processed by Stripe, Inc. ("Stripe"). By using the Platform, you agree to Stripe's Terms of Service and Privacy Policy in addition to these Terms.
- Roam Golf does not store full credit card or bank account numbers. Payment credentials are handled and stored securely by Stripe.
- Listers must connect a valid Stripe account through the Platform to receive payouts. Stripe may require identity verification, bank account verification, and other compliance checks before payouts are enabled.
- Off-session charges (including late fees, damage fees, and lost/stolen charges) are processed automatically to the Renter's saved payment method. By completing a booking, the Renter authorizes Roam Golf to initiate such charges in accordance with these Terms.
- Payouts to Listers may be delayed, reversed, or withheld in cases of suspected fraud, open disputes, chargebacks, or violations of these Terms.
12. Shop Partner Accounts
Golf shops and commercial equipment providers operating on the Platform as shop partners are subject to these Terms as well as any additional shop partner agreement entered into with Roam Golf.
- Shop accounts may list inventory on behalf of the shop and are responsible for ensuring all listed equipment is available, accurately described, and legally eligible for rental.
- If a listed item is sold in-store and is no longer available for rental, the shop must immediately deactivate the listing through the Platform. Failure to do so may result in active bookings being cancelled, for which the shop will be responsible for any resulting refunds and fees.
- When a shop deactivates a listing due to an in-store sale, any active or upcoming bookings for that listing will be automatically cancelled, full refunds will be issued to affected Renters, and the shop account may be subject to the standard lister cancellation fee per affected booking.
- Shop accounts must maintain accurate availability windows and respond to booking requests in a timely manner.
13. Messaging & Platform Communication
All booking-related communication between Listers and Renters must take place through the Roam Golf Platform messaging system.
- Users may not solicit or arrange rental or purchase transactions off-platform that originate from a Roam Golf listing or connection. Any such transactions circumvent Platform fees and violate these Terms.
- Roam Golf may review Platform messages for safety, fraud prevention, and dispute resolution purposes.
- All communications must comply with our User Conduct standards set out in Section 14 below.
14. User Conduct
You agree not to:
- Misrepresent equipment condition, your identity, or your intentions when using the Platform.
- Damage, steal, or misuse rented equipment, or allow others to do so.
- Arrange transactions off-platform with users you connected with through Roam Golf, in order to avoid Platform fees.
- Engage in harassment, hate speech, fraud, abuse, or any other illegal or harmful activity toward other users or Roam Golf.
- Attempt to reverse-engineer, scrape, or otherwise misuse the Platform or its data.
Violations may result in warnings, temporary suspension, permanent account termination, forfeiture of pending payouts, or other actions we deem appropriate, including referral to law enforcement.
15. Ratings & Reviews
After completing a rental, Renters may submit a star rating for the equipment they rented. Ratings are used to build trust and transparency on the Platform.
- Ratings must be honest and reflect the Renter's genuine experience.
- Roam Golf reserves the right to remove ratings that are fraudulent, abusive, or in violation of these Terms.
- Listers may not offer incentives in exchange for positive ratings or attempt to manipulate the rating system.
16. Insurance, Damage & Liability
- Renters are responsible for the equipment from the moment of confirmed pickup (entry of the pickup code) until the return is confirmed by the Lister through the Platform.
- Roam Golf does not provide insurance for users or equipment unless expressly stated in a separate written agreement.
- Users are encouraged to verify whether their personal insurance policies (homeowners, renters, or otherwise) cover rented equipment.
Golf and related activities involve inherent risks. You agree to use all equipment safely, in accordance with manufacturer guidelines, and at your own risk. Roam Golf is not responsible for injuries, accidents, or damages arising from use or misuse of equipment.
17. Disputes Between Users
In the event of a disagreement between users — including disputes about damage, return condition, or timing — Roam Golf may, but is not required to:
- facilitate communication between the parties,
- collect photographs, messages, and other documentation, and
- offer a suggested resolution based on available evidence.
Roam Golf's decisions in dispute resolution are made in good faith based on available evidence and are final. Roam Golf is not a party to rental or purchase contracts between users and is not liable for the outcome of any dispute.
Damage disputes must be filed within 48 hours of the damage fee being assessed. After this window, fees are considered final.
18. Intellectual Property
All Platform content, including but not limited to text, graphics, logos, icons, images, software, and branding, is owned by Roam Golf or its licensors and is protected by intellectual property laws.
You may not copy, modify, distribute, sell, or create derivative works from any Platform content without our prior written consent, except as necessary to use the Platform for its intended purposes.
19. Privacy
Your use of the Platform is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.
20. Termination
Roam Golf may suspend or terminate your access to the Platform at any time, with or without notice, if:
- you violate these Terms,
- you engage in fraudulent or harmful activity, or
- we determine it is reasonably necessary to protect the Platform, our users, or our business.
You may close your account at any time through your settings or by contacting us at support@roamgolf.io. Certain provisions of these Terms will survive termination, including those relating to payments owed, damage or loss claims, intellectual property, limitations of liability, and indemnification.
21. Limitation of Liability
To the fullest extent permitted by law, Roam Golf and its officers, directors, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, or goodwill, resulting from:
- your access to or use of the Platform;
- any conduct or content of other users or third parties;
- unauthorized access, use, or alteration of your data; or
- any equipment condition, malfunction, or injury arising from the use of rented or purchased equipment.
To the extent any liability is established, Roam Golf's total aggregate liability arising out of or relating to the Platform or these Terms shall not exceed the greater of (a) the amounts you have paid through the Platform in the twelve (12) months prior to the event giving rise to the claim, or (b) one hundred U.S. dollars (US$100).
22. Indemnification
You agree to indemnify, defend, and hold harmless Roam Golf and its officers, directors, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:
- your listings or equipment,
- your rentals or purchases,
- your misuse of the Platform or any equipment,
- your violation of these Terms or any applicable law, or
- any damage, loss, or injury caused by equipment you listed or rented through the Platform.
23. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last Updated" date at the top of this page. Material changes will also be communicated by email or in-app notice at least 14 days before they take effect.
Your continued use of the Platform after any changes become effective constitutes your acceptance of the revised Terms.
24. Governing Law
These Terms and any dispute arising out of or relating to them or the Platform are governed by the laws of the State of California, without regard to its conflict-of-law principles. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in California, and you consent to personal jurisdiction in those courts.
